Child Custody
In Illinois, there are three basic forms of child custody, either pursuant to statute or recognized by the courts. At our firm, we will explain each one to you so that you can make a decision of which you want to pursue:
- Sole custody - When a parent has sole custody, that parent is responsible for all decisions regarding the upbringing of the child(ren).
- Joint custody - When parents have joint custody, one parent typically is designated the residential parent and the children primarily reside with that parent and the other parent has scheduled parenting time. Both parents share in the major decisions regarding the education, religious upbringing, and medical care of the child(ren).
- Shared custody - When parents have shared custody, they split the time with the child(ren) approximately equally. This form of custody is rarely implemented because of the possible adverse impact on the child(ren) as they are shuffled between homes, but in some situations it is appropriate and in the best interest of the child(ren).
In child custody cases, the court's primary concern is always what is in the "best interests" of the child(ren). With our experience in these cases, we will discuss with you all applicable custody options.
Child Support
Child support payments are intended to cover the day-to-day living expenses of your child(ren). In Illinois, there are statutory guidelines that advise the judges on the amount of those payments based upon the income of the payor, but judges can deviate up or down from guideline amounts based on certain factors. We will work for you to demonstrate to a judge the proper amount of child support for your child(ren).
Post-Judgment
Often times after a divorce, parties find themselves in court as a result of one of the parties failing to follow the agreement, or one of the parties desires to modify the prior agreement. At our firm, we can represent you with all modifications, including child support and child custody, any other modifications and enforcement of your prior agreement.
